Terms and conditions
These terms apply to every appointment and treatment at DuduM Esthetica. They set out what you may expect from the studio, and what the studio expects from you.
Definitions
In these terms, the following definitions apply:
| DuduM Esthetica | the business of Dudu Ozturk, located at Strijkviertel 56-G, 3454 PN De Meern, the Netherlands, registered with the Dutch Chamber of Commerce under number 92630669, VAT number NL004967387B17. Also referred to as “the studio”, “we” or “us”. |
|---|---|
| Client | the natural person who makes an appointment, receives a treatment or purchases a product. Also referred to as “you”. |
| Treatment | any skin, hair or scalp treatment, analysis, intake or advisory consultation carried out by the studio. |
| Agreement | the arrangement between the studio and the client regarding a treatment or product, including these terms. |
| Website | dudumesthetica.nl and all its pages. |
Applicability
- These terms apply to every offer, appointment, treatment and agreement between the studio and the client.
- By making an appointment, booking online or receiving a treatment, you accept these terms.
- Deviations from these terms only apply if the studio has confirmed them in writing or by email.
- These terms are made available before the agreement is concluded: they are on the website, where you can save or print them, and will be sent free of charge on request.
- These terms apply to treatments and products for consumers. For renting the salon chair to beauty professionals, we make separate written arrangements.
- If any provision is void or voidable, the remaining provisions remain in force. The studio will then replace that provision with a valid one that stays as close as possible to its intent.
Making an appointment
- The studio works by appointment only, so there is unhurried time for each client.
- You can book online via the booking system on the website, by phone, via WhatsApp or by email.
- The agreement is concluded the moment the studio confirms the appointment.
- For a first treatment we allow extra time for the intake.
- The studio is open Monday, Tuesday, Thursday, Friday and Saturday from 10:00 to 18:00. The studio is closed on Wednesdays and Sundays.
Cancelling, rescheduling and no-shows
- Cancelling or rescheduling is free of charge up to 24 hours before the appointment, by phone, WhatsApp or email.
- If you cancel within 24 hours of the appointment, the studio charges 50% of the treatment price.
- If you do not show up without notice, the same rule applies: 50% of the treatment price.
- The studio may reasonably depart from this rule, for example in case of illness or unforeseen circumstances.
- An invoice for cancelled or missed appointments is payable within fourteen days of its date.
- If the studio has to cancel or reschedule an appointment, for example due to illness or force majeure, you will be informed as soon as possible and a new appointment will be scheduled free of charge.
Arriving late
- Let us know if you are running late, so we can see what is still possible.
- If you arrive late, the treatment time may be shortened so that other clients do not have to wait. The full price remains payable in that case.
- If you are more than fifteen minutes late, the studio may cancel the appointment. This then counts as a cancellation within 24 hours.
- If the studio itself runs late, your treatment will not be shortened, or a new time will be arranged in consultation.
Prices and payment
- All prices on the website and in the studio are in euros and include VAT.
- The applicable price is the price stated at the time you make the appointment.
- Price changes are published on the website in advance. If the price changes between booking and treatment, the lower of the two applies.
- If it turns out during a treatment that additional or different work is needed, the studio discusses this with you first and only proceeds with your consent.
- Payment is due immediately after the treatment at the studio, unless agreed otherwise in writing.
- If you fail to pay an invoice on time, then following a free reminder with a fourteen-day payment term, you owe statutory interest and extrajudicial collection costs, calculated in accordance with the Dutch Decree on compensation for extrajudicial collection costs.
Intake, health and contraindications
A safe treatment starts with good information. Before the first treatment the studio carries out an intake, and at follow-up appointments the studio asks about any changes.
- Before and during the treatment you provide accurate and complete information about your health, medication, allergies, skin or scalp conditions, pregnancy or breastfeeding, and any recent treatments.
- If anything changes in your health situation, you report this before the next treatment.
- The studio may refuse, adjust or discontinue a treatment if there is a contraindication or if safe execution is not possible. The studio will always explain why.
- If in doubt, the studio may refer you to a general practitioner, dermatologist or other healthcare provider. The studio does not make medical diagnoses and does not provide medical treatment.
- The studio is not liable for damage resulting from incorrect or incomplete information you have provided.
Carrying out the treatment
- The studio carries out every treatment to the best of its knowledge and ability, in line with the standards of good craftsmanship and using sound materials and products.
- A treatment is a best-efforts obligation, not a results-based obligation: the studio makes every effort to achieve a good result but cannot guarantee a specific outcome.
- Skin and scalp respond differently from person to person. The result, the pace and the number of treatments needed may therefore differ per client.
- The studio informs you in advance about the nature of the treatment, its expected duration and, where relevant, possible side effects such as redness or sensitivity.
- After the treatment you receive aftercare advice. Following that advice is your own responsibility and affects the result.
Minors
- If you are sixteen or older, you can make an appointment independently.
- If you are under sixteen, consent from a parent or legal guardian is required and their presence at the intake is preferred.
- Some treatments are, by their nature, not suitable for minors. The studio assesses this case by case and may refuse a treatment.
Products, aftercare and gift vouchers
- If the studio recommends home care products, purchasing them is always entirely optional.
- If the studio sells products, you may exchange or return an unopened and undamaged product within fourteen days of purchase with proof of purchase.
- Opened cosmetics cannot be exchanged or returned for reasons of health protection and hygiene. This does not affect your statutory rights in the case of a defective product.
- If the studio issues gift vouchers, they are valid for two years from the date of issue, cannot be exchanged for cash and are transferable to someone else.
Liability
- The studio is only liable for direct damage resulting from an attributable failure on the part of the studio.
- The studio is not liable for damage resulting from incorrect or incomplete information from the client, from failure to follow aftercare advice, or from an allergic reaction that could not reasonably have been foreseen.
- The liability of the studio is limited to the amount paid out by its liability insurance in the relevant case, plus the deductible.
- If the insurance does not pay out, liability is limited to the invoice amount of the treatment to which the damage relates.
- The studio is not liable for loss, theft or damage to personal belongings you bring to the studio.
- These limitations do not apply in the event of intent or wilful recklessness on the part of the studio, nor to damage due to death or personal injury. These terms do not affect your mandatory statutory rights as a consumer.
Complaints
- If you are not satisfied with a treatment or product, please let us know, by phone, by email or during a visit.
- Report a complaint as soon as possible, preferably within five working days of discovering the problem, so the studio can still assess the result properly. A complaint reported within two months of discovery is always on time.
- Describe your complaint as clearly as possible so the studio can investigate it properly.
- The studio will respond substantively within five working days and will look for a suitable solution together with you.
- If we cannot resolve it together, an independent expert may be asked to assess the result.
Damage, theft and house rules
- You are liable for damage to furniture, equipment or products caused by careless behaviour.
- In case of theft, the studio always files a police report.
- In the studio we treat one another with respect. In the event of unwanted intimacy, aggression, discrimination or other inappropriate behaviour, the studio will end the treatment. The treatment price remains payable and the studio may deny you access.
- Please do not come to your appointment under the influence of alcohol or drugs.
- If you have a fever or a contagious condition, please reschedule your appointment. There is no charge in that case.
Distance booking and withdrawal
If you book online, by phone, via WhatsApp or by email, this is a distance contract. You then have the right to withdraw from (cancel) the agreement within fourteen days of making the appointment, without giving any reason.
- You withdraw by letting us know clearly via info@dudumesthetica.nl, WhatsApp or phone. You may use the model form below, but you do not have to.
- If you withdraw within the cooling-off period and before the treatment has started, you pay nothing.
- If you want the treatment to take place within the cooling-off period, the studio will ask for your express consent in advance. If you withdraw after the treatment has started, you pay for the part already performed (article 6:230s(4) of the Dutch Civil Code).
- Once the treatment has been fully performed after you expressly agreed to performance within the cooling-off period and acknowledged that you thereby lose your right of withdrawal, the right of withdrawal lapses (article 6:230p under d of the Dutch Civil Code).
- After the cooling-off period, article 4 of these terms applies to cancelling and rescheduling.

Personal data
The studio processes your personal data and treatment records carefully and in accordance with the General Data Protection Regulation. How this works, which data the studio keeps and for how long, is explained in the privacy statement.
Photographs of treatment results are only taken and published with your explicit consent. You can withdraw that consent at any time.
Governing law and disputes
- These terms and all agreements with the studio are governed by Dutch law. If you are a consumer living in another country, you keep the protection of the mandatory rules of that country.
- In the event of a dispute, we will first try to resolve it together.
- If that is not possible, the dispute may be submitted to the court that has jurisdiction under the law.
Changes to these terms
- The studio may amend these terms. The current version is always published on the website, stating the version number and date.
- The version that applies to an appointment is the version in force at the time you made that appointment.
